NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL ENTRANTS HAVE AN EQUAL CHANCE OF WINNING.
Eligibility: Promotion is open only to legal residents of the 50 United States and District of Columbia, who are 21 years of age or older. This Promotion is void where prohibited. Employees, officers, and directors (and their respective immediate family members (spouse, parents, siblings, children) or household members (whether or not related)) of Graco Inc. ("Sponsor"), Graco Inc. d/b/a Sharpe, Graco Inc.'s subsidiaries, affiliated companies, distributors, dealers, and wholesalers, and their respective advertising and promotion agencies are ineligible. By participating you agree to these Official Rules.
To Enter: You may enter for a chance to win beginning 9:00 AM Eastern Time ("ET") 05/15/08 through 11:59 PM ET 03/31/09 ("Promotion Period") by going to www.sharpe1.com (Web site). Click on the icon, banner or text link to access the Sweepstakes registration page, and then follow the directions to enter. Entries must be received and recorded by Sponsor's computer (the official Sweepstakes time keeping device) by 11:59:59 PM PT on 03/31/09. When online, you will be required to accurately enter your full name, address, city, state, zip code, daytime phone number, e-mail address and age. For details on how your information may be used, see our terms of use/privacy policy at www.sharpe1.com. No robotic, programmed, script, macro or other automated entries, or third party entries, (collectively "automated entries"), all of which will be disqualified. Entries will be disqualified if they are altered, delayed, deleted, destroyed, forged, fraudulent,improperly accessed, inaccurate, incomplete, interrupted, late, lost, misdirected, non-delivered,stolen, tampered with,unauthorized or unintelligible.
All entry information submitted becomes the property of Sponsor and will not be returned. Limit 1 entry per person and/or email address. Any attempt by an entrant to obtain more than the one entry by using multiple/different email addresses, identities, registrations, or any other methods will void that entrant's entries and that entrant may be disqualified.
Prize Details/Odds of Winning: One Grand Prize, One winner will be awarded a Custom Bike, built by Stack's Creative Customs with an approximate retail value of $25,000. Winner will not have any options of color selection. Winner is responsible for actions and costs involved in pick-up and/or delivery of the prize. Grand Prize Winner must provide satisfactory evidence of insurance and a valid license to operate a motorcycle at time of delivery or two months from date of prize notification, whichever occurs first. Winner must finalize title transfer within Sixty (60) days. In either event, bike must be redeemed within three months of prize notification or prize will be forfeited. Winner is responsible for all taxes, fees and costs related to motorcycle, including but not limited to all taxes, registration, title and license fees, insurance premiums, extended warranties, options, accessories or other after-market parts ordered by winner, and expenses incurred in claiming or using the motorcycle. Prize cannot be used in conjunction with any other promotion or offer. No prize transfers or cash or other substitutions, except that Sponsor may substitute a prize, in whole or in part, for one of comparable or greater value in the event advertised prize is, in Sponsor's sole discretion, unavailable. Any difference between the stated value and the actual value will not be awarded. Prize will be provided "AS IS" with NO WARRANTY of any kind, either express or implied, including but not limited to implied warranties related to its quality, design, mechanical condition, merchantability, or fitness for a particular purpose. Odds of winning depend on the total number of eligible entries received. All warranties are hereby disclaimed.
Drawing: The Grand Prize winner will be selected via random drawing on or about 04/15/09 from all eligible entries received. The drawing and awarding of the prize will be conducted by Promotion Mailing Center, Inc. an independent judging organization, whose decisions are final and binding in all matters relating to this Promotion. Promotion Mailing Center will attempt to notify potential winner by mail, overnight mail and/or telephone approximately two weeks after drawing.
General Terms and Conditions: By entering, participants agree (a) that Sponsor, its parent, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, (individually and collectively "Releasees") are indemnified, released and will be held harmless by participants from any and all liability, for any damages, injuries or losses of any kind (whether due to negligence or otherwise) to person(s), including death, or property, arising directly or indirectly from the acceptance, receipt, possession, enjoyment, ownership, misuse or use of a prize or his/her participation in this Promotion or any Promotion-related activity; and (b) winner grants (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor's authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web and Internet, without review, notification, approval or additional compensation, unless prohibited by law. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to delivery or use of the prize awarded. By entering, participants agree to complete, sign and return an Affidavit of Eligibility and Liability Release consistent with the above language, and, where lawful, Publicity Release within 14 days of receipt of notification. Participants acknowledge that the custom bike is intended for show, and is not a leisure or comfort bike. If documents are not returned in a timely manner, or if prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and an alternate winner selected. Winner may not transfer, assign, or substitute prize. By entering, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, will be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules. Participants agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorneys' fees; and (3) under no circumstances will participants be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental, and consequential damage, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Limitations of Liability: Releasees are not responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries, mail or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any equipment or programming associated with or utilized in this Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web site. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Promotion or Web site, to be acting in violation of the terms of the Web site or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Releasees are not responsible for injury or damage to participants' or any other person's computer related to or resulting from participating in this Promotion or downloading or copying materials from or use of Web site. If, for any reason, the Promotion is not capable of running as planned, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion, and determine winner in a random drawing from eligible entries received prior to action taken. If due to a production or other error, more prize winners are identified than are intended to be awarded at any prize level as stated in these Official Rules, prize will be awarded in a random drawing from all such eligible prize claims received. Any attempt to deliberately damage any web site or undermine the legitimate operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents. In case of dispute regarding Internet entries, the authorized subscriber of email account used to enter the Promotion, at actual time of entry, will be deemed to be participant and must comply with these Official Rules. Authorized subscriber is deemed to be natural person who is assigned an email address by an Internet Access Provider, online service provider, or other organization that is responsible for assigning email addresses.
